Cover the cost of your membership with Machines4U, or we’ll give your money back

1.     Guarantee Description

1.1 This Machines4U Guarantee represents an additional guarantee to any obligations or requirements imposed on Machines4u.com.au under applicable trade or sales practices legislation.

1.2 The Machines4U Guarantee is valid for a period of 12 months commencing from the date of the membership contract Confirmation Email and applies if all of the following conditions are met:

(a) you have purchased and paid for a 12-month dealer membership package (Platinum, Gold, Silver or Bronze) in its entirety;

(b) all Fees payable by you with respect to your Subscription and/or purchases of any other optional services of Machines4u.com.au have been paid in full;

(c) you have not breached any conditions or obligations imposed on you under these Terms or have cured any such breach subsequent to a notice to cure issued to you by Machines4u.com.au within the time limit specified in such notice to cure;

(d) you have complied with the requirements to:

(i.) Have a minimum of 25 pieces of capital equipment live featuring competitive pricing, photos, video and PDF for the duration of the Guarantee Period;

(ii.) Each listing includes a minimum of 10 photos and pricing for the lifetime of the listing;

(iii.) log onto the Site’s MyMachines4U at least once a month for the duration of the Guarantee Period to review and update your listings, as well as check leads and remove sold listings;

(iv.) create user profiles for your sales team in MyMachines4U; and

(v.) respond to all sales leads generated by your listings on the Site within 48 hours.

(e) you have not sold, or had contract to sell, a piece of equipment listed on the Site that meets all the above criteria during the Guarantee Period; and:

(f) you have submitted a claim in respect of the Machines4U Guarantee in accordance with clause 1.4.

1.3 The Machines4U Guarantee does not apply to:

(a) Businesses that have ceased operation or changed ownership within the Guarantee Period

(b) OEM and Auction House memberships

(c) Individual listing upgrades

(d) Display advertising

(e) Email marketing

(f) Any other Machines4U product or service purchases

1.4 If all of the conditions set out in clause 1.2 apply, you may submit a claim for a refund of the Fees paid by you in respect of the Subscription in the following manner:

(a) you submit a claim in writing for the request of a refund to Machines4u.com.au by way of letter to Machines4U Pty Ltd, PO Box 214, Broadbeach, QLD 4218, Australia; and

(b) your request above must be received by Machines4u.com.au within 10 days from the date of end of the Guarantee Period to which the refund relates.

1.5 If Machine4u.com.au’s liability arising in respect of the Machines4U Guarantee under this clause shall be limited only to the full refund of the dealer membership package fee paid by you to which the refund relates and the first monthly rollover fee paid by you (if any) on end of the Guarantee Period for such dealer membership package. No refunds of any fees paid by you towards set up costs and/or the purchase of additional optional services offered by Machines4u.com.au shall be made.
